Licensing and Regulations How to find out what your state requires. Which businesses need special licenses - This information applies to US businesses, if you live in another country, you may need a VAT tax license, or business licenses through different authorities. If you have information on licensing and regulations that apply to other countries that you'd like to see posted here, please email and let us know. With a shoestring startup, you always have to be on the lookout for ways you can cut corners and save money that will still allow quality operation of your business. This is NOT an area where you can take shortcuts! Business licensing and regulations MUST be meticulously attended to. Business Licenses Business licenses are not required in all areas. Check with your city government to find out whether you need one to operate the kind of business you want to build in the area where you live. If you move, you'll have to check this again. Most states issue a sales tax license, or some form of business sales tax exemption license. You should get this, even if you have a business where you don't collect sales tax, because this is your validation through the rest of the world that you own a legit business. This is your legal business name, even if you don't register a trade-name, if you have a sales tax license with a business name on it. Employer ID An Employer ID (or EID) is issued by the Internal Revenue Service through the Federal Government. When you are asked for a Federal Tax ID number for a business, this is the number they want. If you have a sole proprietorship with no employees, you don't need this number, and you can use your Social Security number instead. If you do have employees, or another form of business then this number is required by the federal government. Licensed Workspace Licensing of your facilities may be necessary if you process, store, repackage, or handle food, cosmetics or personal care items even in passing, or if you offer a service involving physical contact with other people such as daycare, health care, hair or nail care, etc. This is a state issue, and sometimes also a county issue, so check with both. There are usually standards for required sinks, sanitation policies, pest control policies, handling procedures, and other informational or physical requirements. Usually the government personnel in charge of such licensing are very helpful about offering information so you can research, and then meet the necessary standards. Food Handler's License Most states require that if you handle food, that you possess a food handler's license. This can be as simple as a TB test, and as complex as passing a test regarding contamination or freshness issues. This is often handled as a county issue, sometimes at the state level. Check with your local government entities if you have a business that involves food preparation or repackaging. Other Licenses You may be required to obtain professional licensing in some areas for some professions. Again, make sure you check with city, county, state, and federal government agents to insure that you are in compliance with applicable regulations regarding your businss. This is one area where you don't want to mess up, because fines are hefty, and can wipe out all you have built.
